Terms of Service

1. Introduction

Welcome to mivo ("we", "us", "our"). These Terms of Service ("Terms") govern your access to and use of the mivo platform at https://mivo.so (hereinafter "Service") by you ("User", "you").

By using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, you may not use the Service.

2. Definitions

  • "Service Provider": A registered person or organization offering services through mivo.
  • "End Customer": A person booking services from a Service Provider through mivo.
  • "Account": Your user account with mivo.
  • "Subscription": A paid recurring usage according to your chosen plan.
  • "Content": All data, text, media or calendar information uploaded or entered by you.
  • "Third Party": External services like Google, Stripe or others that you voluntarily connect to your account.

3. Service Description

mivo is a cloud-based booking and management platform for service providers. It enables appointment management, calendar synchronization (e.g. Google Calendar), online bookings and customer communication, among other features.

We strive to provide uninterrupted service, but cannot guarantee continuous availability or error-free operation.

We reserve the right to develop, modify or adjust individual features of the Service.

4. Registration and Account Management

  • You must be of legal age and have legal capacity.
  • All information must be correct, complete and current.
  • You are responsible for protecting your access credentials.
  • Activities through your account are considered authorized by you.
  • Accounts may not be transferred or shared.
  • We may suspend or delete your account in case of suspected abuse, security risks or false information.

5. Subscriptions, Payment and Cancellation

  • Using mivo requires an active subscription (monthly or yearly).
  • Payments are processed through third parties (e.g. Stripe). Their terms apply additionally.
  • Subscriptions renew automatically unless cancelled before the end of the current billing period.
  • Cancellations can be made anytime through the dashboard or via email; the account remains active until the end of the billing period.
  • Refunds are excluded to the extent legally permissible.
  • We reserve the right to change prices with reasonable advance notice.

6. Free Usage – mivo Free & Fair Use Policy

If you use mivo Free, our Fair Use Policy applies additionally. It governs the permitted use of the free plan, including potential limits on storage, API requests, synchronizations or support.

We reserve the right to restrict or terminate access to mivo Free if:

  • usage exceeds a reasonable level,
  • automated, abusive or security-relevant activities are detected,
  • or usage violates the Fair Use Policy.

By using mivo Free, you acknowledge the Fair Use Policy as binding.

7. Integrations and Third-Party Services

You may voluntarily connect third-party accounts (e.g. Google or Stripe) to your mivo account. The following rules apply:

7.1 Google OAuth and Calendar Integration

We use Google APIs in compliance with the Google API Services User Data Policy, including Limited Use requirements.

We only request the minimally necessary access rights ("Scopes") to provide features like calendar synchronization. Scopes used:

  • calendar.events.list (to check appointments and prevent double bookings)
  • calendar.events.insert (to create new appointments upon bookings)

All access occurs only after your explicit consent via the Google OAuth dialog.

We do not store or share Google data for advertising or marketing purposes.

You can revoke access anytime through your Google account: https://myaccount.google.com/permissions.

7.2 Additional Third Parties

If you use Stripe or other integrations, their terms and privacy policies apply additionally. We assume no liability for the availability or function of these third parties.

8. Content and Intellectual Property

  • You retain all rights to content you create.
  • By uploading, you grant us a non-exclusive, worldwide license to use, store and display the content solely for providing the Service.
  • mivo, the design, code, logos and all software remain our property and are protected by copyright.
  • Without our written consent, no trademarks, designs or software components may be copied or reused.

9. Prohibited Use

You may not use mivo to:

  • violate applicable law, third-party rights or data protection regulations,
  • conduct spam, malware or automated data queries,
  • circumvent technical protection mechanisms,
  • excessively or abusively burden the platform,
  • or disturb or deceive other users.

10. Disclaimer and Warranty

  • The Service is provided "as is".
  • We do not guarantee uninterrupted, error-free or fit-for-purpose use.
  • Our liability is – to the extent legally permissible – limited to intent and gross negligence.
  • We are not liable for data loss, lost profits or indirect damages.
  • In countries with mandatory consumer protection, statutory rights remain unchanged.

11. Termination and Deletion

  • You may cancel your account at any time.
  • We may suspend or delete your account in case of violation of these Terms, security risks or legal requirements.
  • After termination, rights and obligations that by their nature continue to apply (e.g. license rights, limitation of liability) remain in effect.

12. Changes to These Terms

We reserve the right to change these Terms at any time.

Significant changes will be communicated to you in advance. Your continued use after the changes take effect constitutes acceptance.

If you do not agree, you must stop using the Service.

13. Applicable Law and Jurisdiction

To the extent legally permissible, the law of the Federal Republic of Germany applies.

The place of jurisdiction is the registered office of Franke & Winter GmbH.

Should any provision be invalid, the validity of the remaining terms remains unaffected.
